Case against Alec Baldwin is lost by the family of a Marine killed in Afghanistan In 2023

CHEYENNE, Wyoming: The family of a Marine killed in Afghanistan sued Alec Baldwin for $25 million, but Baldwin’s lawyer said the actor didn’t have to pay anything because he had chastised them on social media about the January 6, 2021, uprising at the U.S. Capitol.

The lawsuit filed by Lance Cpl. Rylee McCollum’s sisters and wife from Jackson, Wyoming, was dismissed by U.S. Southern District of New York Judge Edgardo Ramos in August. The case was closed in October by the judge after the McCollum family failed to file an amended lawsuit by the September deadline, as requested by Ramos.Alec Baldwin

In an email to The Associated Press on Wednesday, Baldwin’s attorney Luke Nikas stated that the client made no payment to settle the case.Alec Baldwin

Court documents state that there has been no further activity in the case. Email correspondence on Thursday elicited no further comments on the case from attorneys for either side, including Dennis Postiglione, who represents the McCollum family. Email correspondence was received on Wednesday, and Postiglione said the McCollum family would not comment.

The lawsuit, initially filed in Wyoming and then in New York, claimed that Baldwin, by accusing Roice McCollum on Instagram of being a “insurrectionist” for having attended former President Donald Trump‘s Jan. 6, 2021, rally in Washington, D.C., which preceded the insurrection that day, exposed the family to a barrage of hate speech on social media in 2022.

According to the lawsuit, Roice McCollum protested lawfully and peacefully, avoided being part of the crowd that stormed the US Capitol, and was never detained or charged after speaking with FBI agents.Alec Baldwin

However, Ramos decided to dismiss the lawsuit because she was a β€œlimited public figure” under the law for discussing her brother’s death in the news and interacting with Baldwin, a well-known celebrity, on social media.

In order to support her position as a restricted public figure, McCollum had to demonstrate that Baldwin had behaved badly toward her. Ramos decided that because Baldwin did not, his remarks were protected by his right to free speech.Alec Baldwin

The lawsuit was brought because Baldwin was in legal jeopardy because of the death of the cinematographer on a 2021 New Mexico film. Halyna Hutchins was killed and director Joel Souza was injured when Baldwin’s gun went off while he was pointing it.

After providing a grand jury with fresh evidence, special prosecutors are now attempting to re-charge actor Baldwin, who was previously found not guilty of involuntary manslaughter.
